Trump v. Casa, Inc. Isn’t About Nationwide Injunctions — It’s About Maximizing Trump’s Power

While the Supreme Court Weighs Judicial Power Against Executive Overreach, Our Constitutional Rights Hang in the Balance

Washington, D.C. — Today, the Supreme Court heard oral arguments on whether federal judges can use nationwide injunctions to block a Trump administration executive order throughout the country. The executive order in question would end birthright citizenship for children born on U.S. soil to undocumented immigrants or temporary travelers — a move that every judge who has considered the issue has found blatantly unconstitutional.

“The Trump administration is using the controversy over nationwide injunctions as a tool to push the MAGA agenda through, attempting to circumvent any oversight for as long as possible until the courts can catch up,” said United for Democracy Senior Advisor Meagan Hatcher-Mays. “The amount of legal challenges during Trump’s second presidency directly reflects the number of overreaching executive orders he has signed — a clear demonstration of his blatant abuse of power. This case is no different. Donald Trump cannot repeal birthright citizenship through an executive order — it is a right enshrined in the 14th amendment.”

If the Supreme Court rules in favor of Trump in this case, his administration can enforce his executive order against anyone who has not sued the administration — even if it loses every single case brought by an individual. As Justice Katanji Brown Jackson said in court today, the administration’s argument “seems to turn our justice system, in my view at least, into a catch me if you can kind of regime … where everybody has to have a lawyer and file a lawsuit in order for the government to stop violating people’s rights.” If the Roberts Court cares about preserving its legitimacy as the protector of our constitutional rights, it must finally put an end to its long-standing efforts to expand MAGA influence by ruling against the Trump administration’s gross misuse of power.
