Roberts Court Rules Against Trump But Leaves the Door Open for MAGA Overreach

Supreme Court Says Venezuelan Migrants Deserve Due Process, But Stays Silent on Trump’s Sham Use of the Alien Enemies Act

Washington, D.C. — On Friday, the Supreme Court dealt a blow to the Trump administration’s unconstitutional attempts to deport Venezuelan migrants without any semblance of due process. The Court did not rule on whether the administration’s invocation of the Alien Enemies Act — a 200-year-old law that gives the president sweeping powers during wartime — was permissible, but simply ruled that the men should be given their day in court.

“It is remarkable that a question as simple as whether everyone has the right to due process — a fundamental right that is at the core of our constitutional system — even came before the Supreme Court,” said United for Democracy Executive Director Stasha Rhodes. “Let’s not forget how we got here. The Roberts Court opened the floodgates for money in politics, gutted the Voting Rights Act, let gerrymandering take hold of our political system and granted Trump a gold-plated get-out-of-jail free card for any crimes he commits as president. Trump knows the Court is in his pocket, which is why his administration feels empowered to invoke obscure 18th century laws to legitimize his MAGA agenda. The Roberts Court may have slowed Trump down in this instance but it’s simply too little, too late.”
